Terms ofservice.

These terms govern your use of U Creator, operated by [Registered entity name: not filled in yet], a Private Limited Company incorporated in India. By creating an account you agree to them. If you are using U Creator on behalf of a company, you confirm you are authorised to bind it.

U Creator is available to users in India only. All amounts are in Indian rupees. You must be at least 18 years old to use it.

U Creator is a marketplace that connects brands with creators, and holds the agreed budget in escrow until the brand approves the delivered work. We are not a party to the contract between a brand and a creator. We do not employ creators, do not direct how work is produced, and do not guarantee the quality or timeliness of any deliverable.

We act as an electronic commerce entity in a marketplace model. The contract for the work itself is between the brand and the creator.

You are responsible for the activity on your account and for keeping your login secure. One account per person or business. Accounts choose a role (brand or creator), and that role cannot be changed later, because ratings and transaction history attach to it.

Information you publish about yourself must be accurate. Misstating your audience, your past work, or your identity is a breach of these terms, and connected-platform statistics are read from the platform rather than accepted as typed.

U Creator charges a flat 15% commission on the value of a brief, deducted from the amount released to the creator. On a ₹10,000 brief the brand pays ₹10,000, the creator receives ₹8,500, and U Creator retains ₹1,500. There is no subscription and no listing fee.

The commission is earned on approval, when funds are released from escrow. A project that is cancelled or refunded before approval carries no commission. The split and any applicable taxes are shown to both sides before a brand confirms a creator. Full detail is on the pricing page.

Budgets are collected when a creator is confirmed and held until the brand approves the work. Payments are processed by Razorpay; card and bank credentials are handled by them and are never stored on our servers. Refunds and cancellations are governed by our Refund & Cancellation Policy.

Creators are responsible for their own tax obligations on amounts they receive, including income tax and any GST that applies to them. We may deduct tax at source and issue the corresponding statements where the law requires it.

You keep ownership of what you upload. You grant U Creator a non-exclusive licence to host and display it as needed to run the service (for example, showing your portfolio on your public profile or in the creator directory).

Ownership of commissioned work transfers from the creator to the brand when payment is released from escrow on approval, and not before. Until that moment the creator retains all rights in the deliverable, and a brand that has not approved and paid has no licence to use it. Anything the two parties agree separately (such as exclusivity, usage terms, or paid-media rights) takes precedence over this clause, and should be recorded in the brief so it is part of the record we would review in a dispute.

Creators warrant that the work they deliver is their own, that they have cleared any music, footage, likeness or location used in it, and that it does not infringe anyone else's rights.

Do not post unlawful, misleading, infringing or abusive content; do not misrepresent your identity, audience or past work; do not attempt to take a confirmed transaction off the platform to avoid fees; and do not interfere with the service's operation or attempt to access data that is not yours.

We may suspend or remove accounts that breach these terms, and may withhold settlement of a transaction while we investigate a credible report.

Ratings may be left after a project completes and are published as given. Both sides rate each other, and neither sees the other's rating until both have submitted or the window closes, so a rating cannot be written in retaliation for one already received.

Reports of policy breaches are reviewed by us. We do not disclose the identity of a reporter to the reported party.

U Creator is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted or error-free, and we give no warranty as to the quality, legality, timeliness or fitness for purpose of any work commissioned through it. Those are matters between the brand and the creator.

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with a brief is limited to the commission we actually received on that brief. We are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings, however caused.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Indian law, including liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or any right you have as a consumer under the Consumer Protection Act, 2019.

You agree to indemnify us against claims brought by a third party that arise from content you posted, work you delivered, or your breach of these terms.

You may close your account at any time. We may suspend or terminate an account that breaches these terms, or where we are required to by law. Termination does not affect briefs already in escrow: those are settled under the Refund & Cancellation Policy before the account is closed.

These terms are governed by the laws of India. Subject to the escalation route below, the courts at [Jurisdiction city: not filled in yet] have exclusive jurisdiction.

Before going to court, please raise the matter with our Grievance Officer, whose details are on the contact page. Most disputes about a specific brief are resolved faster through the process in the Refund & Cancellation Policy.
